On January 26, 2021, the Canadian Society for the Advancement of Science in Public Policy (CSASPPfiled a proposed class-action lawsuit in the courts.

This was done to force provincial authorities to roll back various COVID-19-related measures.

The measures, including potential future ones, are mandated business closures, curfews, travel quarantine, mask-wearing, limits on social gatherings, and more.

The essence of the plaintiff’s argument is that the government’s policies were justified by the existence of an emergency. The emergency in turn was justified by the prevalence of a virus.

The prevalence of the virus was justified by the reportedly high number of positive PCR test results. The plaintiff asserts that the fundamental premise, the latter (PCR testing), was never a reliable tool for diagnosing the presence of a living virus. 

In short, without a verifiable basis, there can be no basis for an emergency.

Covid Restrictions Update

The crowd-funded NGO’s constitutional challenge is brought on behalf of all proposed affected persons. This includes both individuals and businesses.

The two named defendants are the Provincial Health Officer Dr. Bonnie Henry and the Provincial Crown.

The defendants have not, as of this writing, filed a reply, but remain within the time limit of twenty-one days permitted under the civil rules before the plaintiff is at liberty to apply for a default judgment.

We brought this suit because we were inundated with grievances from across our communities and across the political spectrum.

We heard from endless persons who felt their concerns were not being adequately responded to by government officials. Worse yet, those same officials on occasion resorted to name-calling and ad hominem attacks which only aggravated the situation further.

It is always regrettable when citizens need to pursue a civil remedy as a last resort, after having exhausted diplomacy, in order to compel their government to participate in a meaningful dialogue with the people it is supposed to be working for,“ said Kip Warner.

When are Covid 19 restrictions going to be lifted?

Unlike other legal challenges, we are not advancing a limited argument on behalf of a limited demographic claiming that they ought to be permitted to carry on specific limited activities under certain conditions, on the grounds that members of that limited demographic would not be making the emergency worse.

For example, there are some religious establishments bringing such suits. They are arguing that their precautionary measures during gatherings are preventing aggravation of the emergency situation.

We don’t believe that solves the problem. We believe we need to directly engage the fundamental premise that there was never a good reason to declare (and maintain) a state of emergency in the first place. CSASPP’s legal challenge is the only approach that takes the entire house of cards down with a minimum energy trajectory.

Consider that we didn’t even put out a news release. Yet awareness of our campaign went viral (no pun intended) online all over Western Canada.

“We are receiving laudatory support from scientists; biostatisticians; medical and naturopathic doctors. Also the Christian, Jewish, and Muslim communities. Further, senior citizens; small business owners; and concerned parents.

Finally, distinguished members of the bar; philanthropists; government whistleblowers; city councillors; two former premiers; a former deputy prime minister; a former official opposition leader; and many more.

We are having a very busy time keeping up with the inquiries and the volume of documents we are receiving.”

CSASPP is an entirely volunteer-driven, non-profit, and non-partisan NGO.
