You cannot lie during an examination in aid.

It’s not possible to schedule the examination before you have a judgment from a judge (meaning the case is over.)

You will need to serve the person who owes you money with documents. They need to know about the hearing, or they obviously won’t show up.

An examination in aid is really a “getting paid” enforcement hearing. If people can’t collect when they win, then the court system is useless.

Please note that only the person or organization representative can be examined.

If your judgment is for “Joe Smith” then you can’t examine their business partner. You have to examine Joe Smith.

How It Works In The Provincial Court of BC

The rules of small claims are much different from the Supreme Court of BC.

Most of the time, the trial judge will just decide who wins. During the trial, the judge won’t get into how the judgment is to be collected.

In Small Claims, the hearing is called a payment hearing. You should look at Rule 12 of the Small Claims Act. In particular, look into Rule 12 (10).

Fill out the paperwork, and book a date for the hearing. Make sure the person who owes money receives the paperwork at least a week before the hearing. The paperwork needs to be stamped by the Provincial Court before you serve the documents.

Once someone who owes the money is served with the documents for the hearing, they have to go. If not, they can be found in contempt of court. That can result in jail time or a fine.

How The Examination for Aid Works In BC Supreme Court

In the BC Supreme Court, how to get paid after a judgment involves something called a “subpoena to the debtor.”

You can find how to do this in the Supreme Court rules. Most of the rest of the process is the same as Small Claims, so we won’t repeat it here.

However, there is another process in the Supreme Court of BC that you can use. This is called “examination in aid of execution.”

However, this process is quite similar to the subpoena-to-debtor process. There is a formal serving of documents required.

You will likely need to hire a process server. The court sheriffs also might be able to do it for you (for a fee.)

Seeing The Defendant For The First Time

When the person you sued never responded to your lawsuit, this debt hearing might be the first time you see them in court. You might have won via summary judgment.

Sometimes the person who never attended the trial might say they weren’t aware there was a trial.

The risk is that they could try and turn your examination in aid into an appeal for the entire lawsuit.
