Giving Finger to Neighbour Not Enough to Prove Harassment

In April 2021, a dispute arose between Frank Naccache, the complainant, and the accused, Jeffrey Epstein, regarding the latter’s behaviour towards the former’s home. On March 27th, Naccache claimed that Epstein was filming his house as he walked by with his family. However, video evidence showed that Epstein had stopped in the driveway of the house across the street and had not made any gestures toward Naccache’s home.
On April 3rd, Naccache alleged that Epstein was staring at his house and trying to hide the fact that he was recording it. Video evidence showed that Epstein was walking on the opposite side of the road, nowhere near Naccache’s house, and never stopped or slowed down. However, Naccache extracted three zoomed-in screenshots from the video that showed Epstein holding a phone in his right hand, which Epstein later admitted in his testimony.

Pretended to shoot him with a hockey stick
On April 4th, Naccache claimed that a young boy passed by his house and pretended to shoot him with a hockey stick. Naccache did not know who the boy was but believed that he was present during a gathering on March 25th. However, there was no evidence linking Epstein to the boy. Naccache also alleged that Epstein and his wife stared at his house as they walked on the street and that Epstein was pretending to be on his phone.
Video evidence showed that Epstein and his family were walking quietly on the road, and the children never stopped or said anything in the direction of Naccache’s house. Additionally, a young boy ran by and pretended to shoot in the direction of Naccache’s house. Naccache wrote in his log that Epstein kept staring at his house and that the kids were running around throughout the whole road and screaming.

Giving the Finger To Your Neighbour
On the evening of April 8th, Naccache coincidentally found himself behind Epstein’s car while riding his motorcycle. Epstein slowed down and stopped on the road, but did not enter his own driveway. No further events occurred after this encounter.
While Naccache claimed that Epstein was filming and staring at his house, video evidence showed that Epstein was walking by with his family and not making any gestures toward Naccache’s house. The alleged incidents involving the young boy and Epstein’s behaviour on April 4th were not linked to Epstein. The events of April 8th were brief and uneventful.
In May 2021, a dispute between Frank Naccache, the complainant, and Jeffrey Epstein, the accused, continued. On May 12th, Naccache claimed that Epstein appeared to be looking into his house and attempting to see inside the upper floor’s windows.
Video evidence showed that Epstein and his family were simply walking southbound on the road and that the walk lasted only a few seconds and was uneventful. Naccache referred to Epstein as the “crazy neighbour” and suggested that he was “casing the place” and hiding behind a tree, staring at the house.
Honking repeatedly
On May 18th, Naccache was performing renovations on his house’s front staircase using a handheld jackhammer. He was wearing safety glasses and earplugs. Naccache alleged that Epstein drove by in his car, revved the engine, and honked repeatedly, causing him to feel unsafe and disturbed. However, video evidence showed that Epstein’s car drove by without incident and that there was no honking or revving of the engine.
Earlier incidents involved Naccache’s claims that Epstein was filming and staring at his house, driving in the opposite traffic lane, and driving dangerously. However, video evidence showed that Epstein was simply walking or driving by without making any hostile or dangerous movements. Naccache referred to Epstein as “dipshit” and “insane” in his written log, but the court did not see any evidence to support these claims.
While Naccache made several allegations against Epstein, video evidence showed that Epstein was simply going about his business without any hostile or dangerous actions. The court did not find any evidence to support Naccache’s claims, and Epstein’s behaviour was found to be within the realm of regular conduct.

Escalated into a verbal altercation
The case presented before the court involves two neighbours, Frank Naccache and David Epstein, and a series of incidents that occurred between them from March to May 2021.
According to Mr. Naccache, the accused, Mr. Epstein, had been harassing him and his family for months. He claimed that Mr. Epstein had been driving too fast and too close to the children in the neighbourhood. On March 25th, he confronted Mr. Epstein about his dangerous driving, but the conversation escalated into a verbal altercation. The argument moved to Mr. Epstein’s front porch, where Mr. Naccache’s son pushed Mr. Epstein, and Mr. Naccache’s wife scolded him for speaking English.
On April 8th, Mr. Naccache claimed that Mr. Epstein intentionally blocked him on the road and drove in the opposite lane of traffic, which made him feel vulnerable and afraid. However, video evidence showed that Mr. Epstein moved aside to let a motorcycle pass and made no hostile or dangerous movement.
On May 12th, Mr. Naccache accused Mr. Epstein of looking into his house and attempting to see inside the upper floor’s windows. However, video evidence showed that Mr. Epstein and his family were walking southbound on the road and made no menacing motion.
Giving the finger
On May 18th, Mr. Naccache claimed that Mr. Epstein threatened him with a handheld drill, made a throat-slashing gesture, and challenged him to a fight. However, video evidence showed that Mr. Epstein gave Mr. Naccache the finger while walking on the opposite side of the road and made a lateral/horizontal motion with his right hand.
During the trial, Mr. Epstein testified that he and his family were very outdoorsy and friendly with their neighbours. A map was then produced of the surrounding streets, identifying most of his neighbours, and showed that the community was tight-knit. He also admitted that he had been upset during the confrontation on March 25th but denied any intention of harming Mr. Naccache or his family. He explained that on April 8th, he moved aside to let a motorcycle pass and denied driving in the opposite lane of traffic.
The court found him not guilty of harassment
Regarding the May 18th incident, Mr. Epstein denied having threatened Mr. Naccache with a handheld drill or making a throat-slashing gesture. He claimed that he responded with “fuck off” and gave Mr. Naccache the finger as a dismissive gesture. He cooperated with the police and provided them with a voluntary statement about the events.
The Court did not find any evidence to support Mr. Naccache’s allegations of harassment and threats by Mr. Epstein. The video evidence showed that Mr. Epstein made no hostile or dangerous movement, and his testimony was consistent and credible. The Court acquitted Mr. Epstein of all charges.
