A lawyer in Victoria BC was suspended for sexually assaulting his client. In a shocking turn of events, William Heflin, a once-practicing lawyer from British Columbia, faces a six-month suspension and a financial penalty exceeding $4,000 for engaging in inappropriate behaviour with a client at the Victoria courthouse.

The Law Society of British Columbia, in a statement released Tuesday, affirmed that Heflin was found guilty of professional misconduct for sexually harassing a female client whom he was representing in a family law case.

Based on the tribunal’s decision, Heflin had subjected his client to unwelcome verbal and physical advances during an encounter in early October 2020, actions that unequivocally fell under the banner of professional misconduct.

Heflin had arranged a meeting with the client under the pretense of getting her signature on a document signifying the end of his representation. His objective, as determined by the Law Society of British Columbia, was to commence a sexual relationship with her.

Reports from the regulatory body detail how Heflin proceeded to touch and kiss the woman without securing her consent.

In 2017, Heflin was initially retained by the woman to assist her in her pursuit of child and spousal support in a family law case. However, during their October meeting, Heflin divulged his intention to retire from legal practice, his plans to run for city council, and his interest in pursuing a romantic relationship with her. This information was part of a November 2022 decision issued by the tribunal.

While Heflin did manage to get his client’s signature on the termination of representation document, he failed to adequately inform her about the repercussions of this decision. Moreover, the tribunal discovered that he maintained the illusion that he might still serve as her legal counsel.

While Heflin went to register the termination form with the court, his client cleverly started to record audio on her mobile phone. Upon returning, Heflin announced his cessation as her attorney, following which he indulged in inappropriate physical behaviour. Despite Heflin’s assertions, the woman maintained that the encounter was non-consensual.

The tribunal’s findings highlighted that the woman had not exhibited any interest in Heflin beyond the professional relationship. Approximately a week after the incident, she lodged a formal complaint with the Law Society of BC.

Despite the consequences, Heflin persisted in reaching out to the woman, leaving voicemails and even attempting a visit to her residence.

The repercussions of Heflin’s actions have been devastating for the client, who already faced mental health challenges following a nervous breakdown earlier that year. The tribunal’s decision from November 2022 noted that Heflin had abandoned his client at a crucial time, prioritizing his personal desires over her legal needs.

Although Heflin confessed his actions, he refuses to recognize their impropriety, showing blatant disregard for the highly imbalanced power dynamic in his favour.

Heflin, who has severed his ties with the society and currently has no plans for reinstatement, would have to serve his six-month suspension commencing the first business day following any potential reinstatement. Furthermore, Heflin is obliged to cover costs and disbursements amounting to $4,348.57 within one year of the decision.
