If this is something you can help with, could you please let me know the associated costs? The Background: We purchased a rural property with a fence separating it from our neighbor's property. The neighbor purchased their property after we bought ours. The previous owners of our property informed us that they had moved the fence inward to avoid disputes with their neighbor at the time. I recently hired a land surveyor, and the results show that the fence is entirely on our property—by about 1–2 feet in some areas and slightly less in others. Despite this, our neighbor installed an electric wire and hardware on the fence without permission and refuses to remove it. I informed him of my intention to take the fence down and asked him to remove the wire and hardware, but he has not complied. Instead, he has involved the police and hired a lawyer, claiming that I cannot remove the fence. We’ve had ongoing issues with this neighbor. Historically, we used our property to host events like weddings and reunions, but he complained so much to authorities that we stopped. He frequently watches us, videos or photographs us whenever we’re outside, and we suspect his objection to replacing the fence stems from wanting to monitor our activities. Regarding the fence: It runs along the side of both driveways and does not act as a critical livestock barrier for his property. He has cross-fencing in place for his livestock, except for four sheep that rely on a section of the fence. His lawyer is claiming the fence as a boundary fence. I’ve responded to his lawyer as best as I can, but I’m not familiar with land law or fencing exceptions, and I’m unsure of the legal implications of removing the fence. I’m concerned about his lawyer’s claims regarding potential financial liability or infractions if I take it down, and I would greatly appreciate your advice Thank you for your time, and I look forward to hearing from you.
