Aaron Kreaden

Aaron Kreaden, a distinguished partner within the Litigation & Dispute Resolution Group, brings his comprehensive expertise in civil litigation to the forefront. His practice spans corporate-commercial disputes, intricate negligence cases (both professional and otherwise), liability issues concerning directors and officers, class actions, and challenges related to product liability. Kreaden's courtroom presence extends across the nation, having advocated at the Supreme Court of Canada and various other courts in Ontario, British Columbia, Alberta, and Nova Scotia.

Kreaden has played pivotal roles in some of Canada’s landmark auditors’ negligence cases. Notably, he served as counsel for Livent (via its special receiver), navigating through trial, the Ontario Court of Appeal, and ultimately the Supreme Court of Canada. He has also represented one of the principal investors in Bernard Madoff’s fund in a significant Canadian case against its auditors. His experience includes defending auditors and other professional advisors against claims, exemplified by his successful summary judgment motion for WBLI, a case that ascended to the Supreme Court of Canada concerning the topic of expert independence.

Beyond negligence cases, Kreaden is adept at managing complex shareholder disputes and litigation against directors and officers. His expertise is sought after by insurers to defend insured directors, officers, and other entities in class actions and similar suits. Recently, he has engaged in several cases related to oppression and forced buyouts within the context of substantial, family-operated businesses, handling matters both on Ontario’s Commercial List and in Arbitration settings.

Kreaden is also skilled in addressing special situations that require urgent legal intervention, such as swift injunctions, internal investigations, and matters involving proxy fights and shareholder activism.

As for his professional affiliations, Kreaden is a valued member of the Law Society of Ontario, The Advocates’ Society, the Ontario Bar Association, the Canadian Bar Association, and the Professional Liability Underwriting Society, reflecting his deep commitment to the legal profession.

His educational background is as impressive as his professional journey. Kreaden completed his J.D. at the University of Toronto in 2010, following an M.Sc. with distinction from the London School of Economics in 2007 and a B.A., first class honors, from McGill University in 2006. He was admitted to the Ontario bar in 2011, marking the start of a distinguished career dedicated to navigating and resolving complex legal challenges.
