Eliot Kolers

Eliot Kolers stands at the helm of the Litigation & Dispute Resolution Group in the Toronto office, where he also plays a pivotal role in both the Management Committee and the Diversity, Equity & Inclusion Committee. Esteemed by colleagues for his litigation prowess, Kolers is a beacon in corporate commercial litigation, class actions, securities, and competition litigation domains. His courtroom battles often revolve around intricate commercial disputes, including oppression remedies, shareholder tussles, and corporate governance conundrums, alongside the rapid-paced litigation that contested corporate dealings demand.

Kolers has skillfully defended a myriad of class actions that span competition law, securities, and privacy breaches. His advocacy extends beyond the courtroom into commercial arbitrations, and he often collaborates with legal counterparts across the United States and international borders.

A familiar face in the corridors of justice, Kolers frequently presents cases before the Commercial List of the Ontario Superior Court of Justice and navigates all tiers of Ontario’s judicial system. His expertise has also led him to argue cases in appellate courts across provinces, the Federal Court of Appeal, and even the Supreme Court of Canada. Beyond, he has represented clients before the federal Competition Tribunal and the Ontario Securities Commission among other regulatory bodies.

In terms of professional engagement, Kolers aligns with the Canadian Bar Association, dips into the American Bar Association’s Antitrust Law Section, engages with The International Bar Association, and is an active member of the Metropolitan Toronto Lawyers Association. His leadership and expertise have seen him serve on the Board of The Advocates’ Society, helm executive positions within the Ontario Bar Association’s Civil Litigation Section, and chair the Canadian Bar Association’s Competition Law Section’s Class Actions and Private Enforcement Committee.

Since 2014, Kolers has been the guiding force behind Class Action Defence Quarterly, a publication by LexisNexis, as its editor-in-chief.

His litigation and dispute resolution acumen is matched by a solid educational foundation, with both a Bachelor of Arts and an LL.B. from the University of Toronto, attained in 1991 and 1994 respectively.
